Welcome to HIR Digital Desk LLC ("we," "us," "our"). These Terms and Conditions govern your use of our AI receptionist services for your mechanic shop ("Service"). By subscribing to or using our Service, you agree to be bound by these terms.
1. Service Description
HIR Digital Desk LLC provides custom-built AI receptionists for mechanic shops in the United States. Our AI receptionists are designed to answer incoming phone calls and, when a customer provides their consent, send automated SMS messages, such as appointment links, to the customer.
2. SMS Communications and Consent
Your use of our Service includes automated SMS communications with your customers. You are responsible for ensuring that all necessary consent is obtained and documented from your customers in compliance with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA).

Consent Over the Phone: Our AI receptionist is designed to obtain verbal consent from your customers during a phone call. The AI will clearly confirm the customer's agreement to receive SMS messages, and this consent will be recorded as part of the call.

Simplified Privacy Notice: During the consent process, a brief privacy notice will be provided verbally. This notice will inform the customer that:

The purpose of the SMS is to provide necessary information, such as an appointment link.

Any data collected will be used only for the purpose of providing the Service.

The customer can opt-out of receiving future SMS messages at any time.

Opt-Out Option: All SMS messages sent through our Service will include an easy way for customers to opt-out. Customers can simply reply "STOP" to the message to be removed from all future communications.

Best Practices and Regulatory Compliance: You agree to use the Service in a manner that aligns with SMS communication best practices, including sending concise and necessary information. While we provide the tools, it is your responsibility to ensure compliance with all local, state, and federal regulations regarding SMS communications and customer consent.
3. Service and Money-Back Guarantee Requirements
To qualify for our services and the money-back guarantee, you must meet the following requirements:

Business Location: Your mechanic shop must operate within the United States.

Management Software: You must use or switch to a shop management software that has a scheduling link. We recommend Shop Boss.

Setup Response: You must respond to all setup emails within 1-2 business days.

Form Completion: You must completely and accurately fill out all required setup forms.

5. Termination and Modification
We reserve the right to suspend or terminate your Service for any misuse or breach of these Terms and Conditions. We may also modify these terms at any time by providing you with notice. Your continued use of the Service after any such modifications constitutes your acceptance of the new terms.
